Welcome to Type By Faith. These Terms of Service ("Terms") govern your access to and use of typebyfaith.com and all related services (collectively, the "Service") operated by Dacfact LLC ("we", "our", or "us").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to all the terms and conditions, you should not access or use the Service.

2. Using Our Service

2.1 Account Creation

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. We may access your account for administrative, support, or security purposes.

2.2 Acceptable Use

You may use our Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates applicable laws or regulations
• Attempt to interfere with or disrupt the Service or servers connected to the Service
• Attempt to bypass any security measures we employ
• Use any data mining, robots, or similar data gathering methods
• Impersonate or attempt to impersonate us, our employees, or other users

3. Bible Content

The King James Version of the Bible used in our Service is in the public domain in the United States. We provide this content for typing practice and spiritual reflection purposes only.

4. Intellectual Property

The Service and its original content (excluding the Bible text), features, and functionality are and will remain the exclusive property of Dacfact LLC. Our Service is protected by copyright, trademark, and other laws of the United States and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

5. User Data

We will maintain certain data that you transmit to the Service for the purpose of managing your typing progress, as well as data relating to your use of the Service. This includes bookmark categories you create and the passages you save to them. Although we perform regular routine backups of data, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Service.

5.1 Shared Bookmark Collections

You may choose to share your bookmark collections with other users by generating a share token. When you share a collection:

• Other users can view the category name and bookmarked passages
• Users who "follow" your collection will see updates you make
• Users who "copy" your collection receive a one-time snapshot they can edit independently
• You remain responsible for the content of category names you create
• You can delete a shared category at any time, which will remove access for all followers

You agree not to use bookmark sharing to distribute offensive, inappropriate, or misleading category names. We reserve the right to remove shared content that violates these Terms.

5.2 Shepherd's Hub

Type By Faith offers a Shepherd's Hub feature that allows premium subscribers to create discipleship groups and track student progress. When you use this feature:

• As a Shepherd (Premium Required): You can create groups, generate access codes, and view student activity data including streaks, verses typed, reading time, WPM, accuracy, and VOTD completion. You are responsible for using this data appropriately and respecting student privacy.
• As a Student (Free): You can join groups by entering an access code. By joining, you consent to share your typing activity data with the shepherd leader. You may leave a group at any time from your Account page.

We are not responsible for how shepherd leaders use student data. Students should only join groups led by individuals they trust. Shepherds must not misuse student data or share it with unauthorized third parties.

6. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may contact us using our contact form.

7. Limitation of Liability

In no event shall Dacfact LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any unauthorized access, use or alteration of your transmissions or content

8. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States and the State of North Carolina, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

10. Premium Subscription and Billing

10.1 Subscription Plans

Type By Faith offers both free and premium subscription plans. Free features include verse-by-verse typing (10 per day), timed tests (2 per day), Reading Mode (mobile-friendly Scripture reading with time tracking), basic Memory Verse access (5 verses), and Rhythm Mode Stage 0. Premium subscriptions remove daily limits and provide access to additional features including Chapter-by-Chapter typing, full Rhythm Mode access (Stages 1-7), Memory Verse with all themes and audio (200 verses across 40 themes), and Shepherd's Hub group management.

10.2 Billing

Premium subscriptions are billed on a recurring monthly basis. By subscribing, you authorize us to charge your payment method on file for the subscription fee plus any applicable taxes. Subscription fees are charged at the beginning of each billing period and are non-refundable.

10.3 Cancellation

You may cancel your premium subscription at any time through your Account Settings page. Upon cancellation, you will retain access to premium features until the end of your current billing period. No refunds will be issued for partial billing periods or unused time.

10.4 Price Changes

We reserve the right to change our subscription pricing at any time. We will provide you with reasonable notice of any price changes, and such changes will take effect at the start of your next billing cycle. If you do not agree to a price change, you may cancel your subscription before the new price takes effect.

11. Refund Policy

All subscription payments are final and non-refundable. Type By Faith does not offer refunds or credits for partial subscription periods, unused time, or any premium features you choose not to use. This no-refund policy applies regardless of whether you cancel your subscription voluntarily or your subscription is terminated for violation of these Terms.

When you cancel your subscription, you will continue to have access to premium features through the end of your current billing period, and your subscription will not renew for subsequent periods.

By purchasing a premium subscription, you acknowledge and agree to this no-refund policy.

Exceptions: We may, at our sole discretion, offer refunds in exceptional circumstances such as technical issues that prevent access to premium features for an extended period. Such refunds are not guaranteed and will be evaluated on a case-by-case basis.

12. Taxes

All subscription fees are exclusive of applicable taxes unless otherwise stated. You are responsible for paying all taxes associated with your purchase of our Service. If we are required to collect or pay taxes on your subscription, such taxes will be charged to you at the time of purchase.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
